Among a great number of problems existing in China's seed industry, the counterfeit seed is particularly serious. The Chinese government has been taking a strong stance against illegal act of infringing intellectual property rights, and operating counterfeit and shoddy products. In the first half of this year, China's agricultural departments totally investigated and dealt with 117 cases of seed infringing acts, with 19 illegal enterprises banned and over 2,000 tonnes of faking seeds destroyed.

However, counterfeit seed has been repeated and rampant, mainly due to the imperfect regulatory system. Ministry of Agriculture is actively exploring and establishing the long-term mechanism to combat seed counterfeiting. There have been three major measures being raised: DNA fingerprinting database of rice and corn varieties should be established to identify counterfeit seeds; a seed intellectual property alliance of seed enterprises will be constituted while severely punishing offenders; more smooth public tip-offs also needs to be built to strengthen supervision over seed counterfeiting.

With the flooding of counterfeit seed, public awareness of protecting of intellectual property rights has been greatly enhanced in domestic. According to the statistics, the applications for variety rights in the first half of 2011 have increased by 11% over the same period of last year, and the applications in enterprises rise by 45%.

At present, regional governments are making efforts to prepare the implementation measures for developing modern crop seed industry. It is expected that, the new mechanism of companies collaborating with institutes linked by crop varieties would enhance the protection of intellectual property rights.
